Trading financial markets involves substantial risk of loss. Past performance and AI-generated analysis do not guarantee future results. You should never trade with money you cannot afford to lose.

By using our services, you acknowledge that all trading decisions are your sole responsibility. We are not liable for any financial losses incurred from using our analysis tools.

1. Acceptance of Terms

By accessing or using WellFX AI, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services. These terms constitute a legally binding agreement between you and WellFX AI.

2. Description of Services

WellFX AI provides:

  • AI-powered technical analysis of trading charts
  • Smart Money Concepts identification (order blocks, liquidity zones, imbalances)
  • Entry/exit point suggestions based on technical patterns
  • Risk-reward ratio calculations
  • Analysis history and tracking

These are analytical tools only. All trading signals and analysis are for educational purposes and should not be considered financial advice.

3. License and Subscription

License Types

  • Trial: Limited free trial with restricted features
  • Monthly: 30-day access with full features
  • Yearly: 365-day access with premium benefits
  • Lifetime: Permanent access to the platform

Usage Limits

Each license includes daily analysis limits. Unused analyses do not roll over to the next day.

License Restrictions

  • Licenses are non-transferable and for single-user use only
  • Sharing license keys or account credentials is prohibited
  • We reserve the right to suspend accounts violating these terms
  • Refunds are provided only in exceptional circumstances at our discretion

4. User Conduct and Restrictions

You agree NOT to:

  • Use the service for illegal activities or fraud
  • Attempt to reverse engineer, hack, or compromise the platform
  • Share, resell, or redistribute our AI analysis without permission
  • Create multiple accounts to circumvent usage limits
  • Upload malicious files or attempt to overload our systems
  • Scrape, crawl, or extract data using automated tools
  • Misrepresent our analysis as your own financial advice

5. Referral Program

Commission Structure: Earn 10% commission on all referred user purchases

Withdrawal Requirements: Minimum withdrawal amount is $50 USD. Withdrawals are processed via PayPal within 7-14 business days after approval.

Prohibited Activities: Creating fake accounts, using misleading marketing, or engaging in fraudulent referrals will result in account termination and commission forfeiture.

6. Intellectual Property

All content, features, and functionality of WellFX AI, including AI algorithms, design, graphics, and software, are owned by us and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of the trading charts you upload, but grant us a license to process and analyze them for service delivery and improvement purposes.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any trading losses, missed opportunities, or financial damages
  • The service is provided "AS IS" without warranties of any kind
  • We do not guarantee accuracy, completeness, or reliability of AI analysis
  • We are not responsible for third-party services (payment processors, AI providers)
  • Our total liability is limited to the amount you paid for your license

8. Indemnification

You agree to indemnify and hold harmless WellFX AI from any claims, losses, damages, or expenses (including legal fees) arising from your use of the service, violation of these terms, or infringement of any rights of another party.

9. Termination

We reserve the right to suspend or terminate your account at any time for:

  • Violation of these Terms of Service
  • Fraudulent activity or abuse of the platform
  • Non-payment or chargebacks
  • Any reason at our sole discretion

Upon termination, your access will be revoked, and no refunds will be provided unless required by law.

10. Changes to Terms

We may modify these Terms of Service at any time. Significant changes will be communicated via email or platform notification. Continued use of the service after changes constitutes acceptance of the new terms.

11. Governing Law

These terms are governed by the laws of South Africa. Any disputes shall be resolved in the courts of South Africa. If any provision is found unenforceable, the remaining provisions will continue in effect.
